The team assists clients in of acquisitions of rural and urban properties, identifying risks arising out of the title chain, real estate registry situation, fraud of execution and/or fraud against creditors, among others, focusing on proposing effective remedies to address any issues. Our expertise also covers real estate development (incorporação imobiliária) and the formation of condominiums (instituição de condomínio), timeshare, land regularization, administrative procedures at Real Estate Registry Offices, subdivisions, construction contracts, typical and atypical leases (built-to-suit and sale&leaseback), development of private projects in public areas that are subject to concession, all types of guarantees on real estate, surface rights, issues related to urban law, among other topics.

 

In addition, the real estate law department works in close coordination with other areas of the firm, such as tax, corporate, project financing and environmental, both to support such practices in connection with the review of real estate law matters, as well as to draw on their expertise for the structuring and negotiation of investments.

 

In particular, the real estate law department participates actively and in coordination with the firm’s banking and capital market team in transactions involving the securitization of real estate receivables or formation of real estate investment funds.
