New Ordinance from the Ministry of Mines and Energy changes rules for classifying investment projects by electricity distribution concessionaires as priorities

MME Ordinance No. 245/2017 (“Ordinance 245/2017”) was published yesterday, which governs the requirements and procedures relating to the approval of investment projects in electricity distribution infrastructure as priorities for the purposes of article 2 of Law No. 12,431 , of June 24, 2011 (“Law 12,431/2011”) and Decree No. 8,874, of October 11, 2016 (“Decree 8,874/2016”), revoking MME Ordinance No. 505, of October 24, 2016 ( “Ordinance 505/2016”), which addressed the topic.
