On May 20, 2015, the Brazilian antitrust authority (“CADE”) issued“Guidelines for the Assessment of Gun Jumping” (“Guidelines”) that outline which acts the Parties to M&A deals, among other transactions, could or could not perform before obtaining CADE’s clearance. The idea of the Guidelines is to provide businesses a better understanding of how the agency is likely to evaluate gun jumping cases.
